District Court stays claim because of Australian Financial Complaints Authority’s bureaucratic bumbling — Sterling Law QLD

It is well known that many public bodies these days are obsessed with political correctness and identity politics, and spend a lot of their time fussing on topics such as equity, diversity, inclusion, harmony days, ‘unconscious bias’, and the like. Once can only imagine that they hold regular meetings where they talk about topics such as their gender pronouns, paleo pear and banana bread, and what a relief that in a few months time the Morrison federal government will be replaced by a Labor-Greens Coalition, but how the ideal would be a Greens Government with Adam Bandt as Prime Minister and socialism being tried once again.

Supporters and apologists of this frivolity often use the cliché that organisations can “chew and walk gum at the same time”, however a recent District Court decision to stay a proceeding as a result of bureaucratic bumbling undermines such claims.

The facts

The Australian Financial Complaints Authority is an external dispute resolution scheme that is supposed to deal with complaints from consumers and small business about financial products and services. 

The following case reveals that the extent to which AFCA deals with complaints is doubtful, however we were elated to find out that what is not in doubt is that it commemorates ‘Transgender Day of Remembrance‘, and on its own admission everyone at AFCA recently wished us a Happy Mardi Gras.

On 25 November 2019, ANZ Banking Group applied to the District Court for recovery of possession of mortgaged properties on the basis that the debt that is secured by those mortgages had not been paid by the respondent debtors. The debtors then made complaint to AFCA, which resulted in the proceedings being adjourned pending AFCA’s determination. In September 2021, AFCA belatedly issued what it called a recommendation, which was not binding on the parties.

Barlow DCJ decided to stay the proceedings because of the delay occasioned by AFCA.

Failing Civility 101 on QandA

Hands up who watched the young minions of the left making utter fools of themselves last night on QandA? It really was a less than encouraging display of utter stupidity and it was certainly of no advantage to anyone who supports the former government this is how the Guardian described the event:

Monday night’s broadcast was forced off-air for several minutes when protesters unfurled a banner and started chanting about potential deregulation of universities.

Australia‘s education minister, Christopher Pyne, had already been asked two questions by people hostile to the changes to university funding, such as deregulation and an increase in how much students pay, when demonstrators started chanting from the balcony of the studio.

The protesters had been chanting “No cuts, no fees, no corporate universities” under a banner that read: “More brains not war planes. Fund Education. May 21 Rally and UTS. 2.30pm”

The live broadcast cut to footage of singer Katie Noonan from a previous programme while the protesters were ejected. Pyne had said it reminded him of Question Time as they moved on to their next chant, “Christopher Pyne get out, we know what you’re all about. Cuts”.

When the cameras cut back to the show, the protesters had been escorted out and the audience cheered and applauded.

Host Tony Jones said: “That was not what democracy is all about.” Pyne then resumed his answers to the questions about deregulating universities.

The minister had been repeatedly interrupted by shouting in the lead-up to the protest and Jones had reprimanded those yelling, saying the microphones would stay away from them.

When Pyne resumed his answer he said the Hecs scheme, in which university students pay back their loans with inflation added when they reach a certain income threshold, was part of the “egalitarian society” and the government would not be changing that.

“The thing about the Australian education system is that there is nobody who can’t go to university in Australia because of fees, because every single dollar can be borrowed and paid back in later life,” he said.

“That is one of the great things about the higher education system in Australia. It’s not the case that people from low socioeconomic status background are shut out of university because of fees. It is quite a misnomer and a myth to say so because every single student is capable of getting a loan from the taxpayer.”

 Any one who follows me on twitter (all 65 of you ) would have noticed the complementary things I posted about Christopher Pyne who remained utterly unfazed and who went on to prove just what a fine performer he is under pressure remaining calm cool and collected.  The protesters were  ejected from the venue while we the audience were shown a pre-recorded musical interlude.

If the idiots form “Socialist Alliance” think that they did any favours for their cause by this display of bad manners and crass behaviour they are sadly mistaken all they did was prove that a university education is utterly wasted on them.  Civil society has to be predicated upon civil behaviour and they were the exact opposite of civility. Worse still what they were protesting about was not even an element of ACTUAL government policy it was something suggested in a report TO the government.  Clearly higher education has been wasted on this minions of the far left and maybe it would be better for the nation and the polity if they were expelled and perhaps made to spend some time in the real world where they had to, you know, like get a job and take a few lessons in”the university of life”. Sadly I expect that they would fail that course just as badly as they clearly failed Civility 101.

Some thoughts about mooted changes to Media ownership law in Australia



People are creatures of habit and it is only that so many people are habituated to buying the news papers that any are still being sold at all. Just take any kind of commute on public transport and consider how many people are reading a paper and how many are staring at a screen instead. Some certainly may be playing games or even watching video but I expect that they will be out numbering those who are still reading dead tree editions of the MSM.

Then there is the things in the paper that people buy them for, most papers are not exclusively about politics and current affairs anyway, so some readers will be buying the paper for its coverage of sport, lifestyle or even just for the crossword puzzles.  My point is that the political classes (in particular those from the left ) just look at the raw sales figured and they think that every reader of the Herald Sun is in the thrall of Rupert Murdoch and that the owners dictate to their readers directing their opinions. The reality is that all media entities write to their audience. If they don’t their audience wither away quite quickly.  With the coming of the internet this is even more how things work Online entities are even more in an endless quest for readers so you have to play to what your readers want rather than thinking that you can manipulate their thinking. I have been writing a blog for nearly a decade now and I have noticed just how quickly particular readers flit in and out its the same now with the way that people read things online from the likes of Murdoch, Fairfax or even the Guardian People don’t just get their news from one source any more no matter what the subject is they will read what several sources say about it and then make up their mind. This behaviour is the same when it comes to broadcast TV people flit form one channel to another seeking different perspectives. My argument is simple, if the media  consumers have changed their habits then perhaps there is something in the notion that media diversity laws from the last century should perhaps reflect those changes as well.

The begging bowl never enhances the look of any business and the SPC bid for government money certainly strikes me as a bit of underhanded blackmail. and what is especially galling is that the parent c0mpany Coca Cola Amatil  are far from short of a quid themselves. To be honest the driving force here is the foolishness of allowing unfettered imports of cheap  product because it enhances the profits of the supermarkets. As the family shopper I make a special effort to avoid foreign produce and imported canned and preserved fruit but when you see the price differential its hardly surprising that many shoppers are less discerning that I am.

I know that this may horrify some of my conservative friends but it seems to me that this whole saga is a very good argument for grower’s cooperatives running canning companies to preserve and market their produce.  Its also a damn good argument for  tariffs imposed upon all agricultural produce that we ourselves grow.

In another example of shopping sadness the butcher shop that I have been patronising for nearly thirty years is to be either sold or closed within the next 12 weeks and I am less than pleased about the prospect. Angus and Tom have been great examples of the perfect store keepers with well priced quality product and exemplary service to their customers. Its the very old story of a shopping mall management greedily charging outrageous rents and greedy adjacent  supermarkets (Aldi and Coles) selling packaged meat at below cost prices. If they can find a buyer they will sell the goodwill but if they can’t then they will walk away. I know that that is the reality of free enterprise but I can’t help but think that its a far from attractive reality.

Strewth, looking back on this post  I think my inner lefty has escaped! Now that is a real worry!

I hardly go there .. if at all.

Not a lot anyway.

but I do often go to the page of a beautiful woman I know just to look at her latest posts and photos. She is really beautiful even more than Laura. And hot if nothotter.

Lets call her Kylie. Well lets .. its her real name after all.

Somehow Kylie must of found out I was stalking admiring her from upclose and personal like and now shes removed all her personal info and photos from her fb page.

All thats left is a photo of her two kids (who are pretty ugly like her husband is) … and her “Likes”, you know the other FB pages she “likes”.

Well I still think Kylie is hot but this stuff is like anger and bile directed at the world. This woman that Kylie “likes” is not only a loose canon shes likely to go out and kill someone.

What does Anzac Day mean?

Believe it or not, today the Herald Sun has seen fit to photoshop the captains of Collingwood & Essendon AFL teams in front of Melbourne’s Shrine of Remembrance.

Worse still, they’ve then stuck the Anzac logo over the pair.

Is it the love of beer that prevents Damian Doyle from converting to Islam?


Damian Doyle has always struck me as a strange individual, so sanctimonious and so judgemental of yours truly and so full of condescension for anyone who does not hold beliefs concurrent  with his own. He is an avid consumer of what I call “disaster porn” and if there is some natural disaster in the third world he is onto it like a flash tweeting about it or decrying the tardy response of the west to said disasters. Anyway  our Damian has written a rather wordy piece about the way that Islam is perceived in this country and in it he sneers at  any and all criticism of that faith.

During the question and answer session it became clear that many members of the audience were genuinely curious about Islam. Having heard so many terrible things about the religion – not just at the forum but elsewhere too – they wanted to understand its core teachings and central texts. One woman commented she had attempted to read the Qur’an but found it unintelligible and confusing. That’s a pretty normal response as it’s a very different book to, say, the New Testament. “So where can we learn more about Islam?”

The response at that forum, naturally enough under the circumstances, was not all that helpful. The conveners were unanimous in their advice, “There’s an excellent website called Jihad Watch, which is run by an organisation that we’re linked with. Its main author, Robert Spencer, has also written a lot of books that are essential reading”.

Of course, you don’t need to attend a meeting of the Q Society, a fringe group fighting the good fight against the ‘Islamisation of Australia’ and the implementation of sharia law in our school tuckshops, to meet people who see Islam as a baffling unknown. Through conversations in pubs and coffee shops, by reading letters in tabloid newspapers and on blogs, or by listening to commentary on television or radio, it’s easy to see that Islam is a poorly understood religion in Australia.


Notice the way that Doyle frames his barely concealed contempt for anyone who is critical of Islam? The reference to Tuck-shops is clearly an allusion   to the cruelty concerns of the issue of the conversion of institutional food sources to halal even when only a very tiny number of the consumers are Muslim. It seems to me that Doyle is suggesting that only very favourable discussion of Islam should ever be listened to and considered and that anything that is at all critical of Islam is haram.

  Please dear readers go to his piece and you will find a great example of quisling rhetoric in full flight, an essay that even tries to play down the significance of Female Genital Mutilation Note his choice of words to describe the practice:

A sad example of this is the issue of female genital cutting. The attendees at the Q Society forum would have been left with the impression that female genital cutting is an Islamic practice as an example of the religion’s repression and abuse of women. By contrast, the conference attendees heard an account of a pre-Islamic cultural practice being eliminated from a community as a result of a local imam’s leadership during the 1950s.


Yes Damian we have all heard  that line and although it may be true in the most pedantic sense for every Muslim society that abhors and rejects the practice there are many others who are at best indifferent to the vile practice..

It seems to me that for Damian   dreams about is an uncritical acceptance of Islam   and the practice of the faith, both here and elsewhere in the world, and a substantive deference to the sensitivities of those who follow that faith. Thus he wants no criticism of the hot heads who call for the beheading of  unbelievers   and he wants to see nothing but positive  PR for the faith within the Australian community.:

And so I’ve decided to start small. To think about the things I can influence, rather than those I can’t. People will decide for themselves what to believe about Islam and its role in society, both in Australia and globally. Some will continue to reach out to sources of information that, in my view, are toxic and uninformed. I need to remember that a simple thing I can do is to let them know there are other sources, that those sources can be trusted, and that obtaining information from a range of sources is the best way to become informed.


The trouble with this exercise in parsimony, as readers of this blog will know, is that Damian  considers any sort of criticism of Islam at all is an example of “bigotry” and I can’t help thinking that the only thing that is preventing Damian from going the whole hog to making the declaration ” There is no god but Allah and Mohamed is his prophet” must be  Mr Doyle’s love of beer.
